In 1835, Governor Bourke, in response to the overcrowding and chaotic state of King Street Courts, directed the design of a courthouse outside Sydney Town, on the hill opposite the new goal. This was for convenient prisoner access and to separate criminal from civil matters.

Designed by colonial architect Mortimer Lewis, the Greek-revivalist building was completed in 1845. It was the first purpose-built criminal court in the colony and has been used ever since as a courthouse. The District Court took up residence in the early 1900s, and a new wing to the courthouse was added. In the 1920s, the newly founded High Court moved in, and additional courts were built. Today, Darlinghurst Courts constitute seven courtrooms and hears Supreme Court and District Court matters.

Bus routes to Bondi Junction or the Eastern suburbs from the city provide convenient access to the Darlinghurst Courthouse. Museum train station provides the closest rail access to the courthouse. The nearest parking area is St Vincent's Hospital.
